TERMS
I. Legally Binding Agreement
Please read the terms of this Terms of Use (“Agreement” or “Terms”) carefully before using our website (“Site”). This Agreement forms a legally binding contract between you and the City of Leawood (the “City,” “we,” or “us"). Any use of the City’s Site in excess of the rights granted in this Agreement is strictly prohibited and constitutes a violation of this Agreement. The City reserves the right to report any breach of this Agreement or unauthorized use or misuse of our Site to law enforcement authorities.
IV. Accessibility to Site
The City is committed to providing all individuals with the opportunity to access our Site.
V. Ownership and Permissible Use of the City Content
The City’s Site and all of its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design selection and arrangement thereof) are owned by the City, the City’s licensors, or other providers of such material.

You are permitted to access, view, and use the City’s Site and to download, copy, or print one copy of the City’s Site Content solely for your own personal, non-commercial use provided that you include all copyright and other proprietary notices contained in the original the City content. Unless otherwise permitted or authorized by law, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise process any of the material on the City’s Site unless you obtain prior written approval.

All materials, links, and information presented on or through the City’s Site are made available solely for general informational purposes. Such information is not intended to be, nor should it be, considered legal advice.

Our Site is provided “as is” and “as available.” The City provides the information on this Site as a public service and the information contained is continually under development. IX. Dispute Resolution
Choice of Law: The laws of the State of Kansas will govern these terms and conditions and other City policies. Disputes relating to intellectual property rights or infringement claims shall be governed by United States federal law.
X. Updates to Agreement
The City reserves the right to update this Agreement at any time by posting an updated Agreement on our Site. You agree to be bound by any such updates. This Agreement may not be orally modified. Neither you nor any of the City employees or agents are permitted to change the terms of this Agreement.
XI. Termination
At its sole discretion, the City may modify or discontinue our Site or may modify, suspend, or terminate access to our Site, with or without notice to you, at any time, for any reason, and without liability to the City or any third party. This Agreement will expressly survive and will still be in effect, despite any such modification, discontinuation, suspension, and/or termination.
XII. No Waiver
No waiver by the City of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of the City to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
